NEW DELHI: The Supreme Court on Friday directed the Directorate General of Health Services (DGHS) to conduct a second round of counselling to fill the 239 vacant seats in the post-graduate medical/dental courses under the 50 per cent all-India quota. A Bench, comprising Justices Y.K. Sabharwal and P.P. Naolekar, passed the order on a petition by a candidate, Amit Gupta, alleging that some all-India quota seats, which could not be filled at the end of the first counselling were being reverted back to the States. The Bench gave this direction to ensure that the seats were not reverted to the States and also that no seat went waste. Based on the suggestion given by the Additional Solicitor-General, Mohan Parasaran, and counsel Maninder Singh on behalf of the Medical Council of India, the Bench asked the All-India Institute of Medical Sciences, which conducted the all-India entrance test, to come out with the admission list in three days. Thereafter, the Bench said that another 405 candidates would be called for the second round of counselling to fill the 239 vacant seats (out of the total 2,700 seats under the all-India quota) within 15 days. The Bench made it clear that if some seats remained vacant even after the end of the second counselling, they could be filled by the States from their quota. The Bench modified the earlier orders dated April 8 and 11 restraining the States from filling the seats meant for the 50 per cent all-India quota. With a view to putting in place a mechanism for the next academic year, the Bench directed the States to inform the DGHS by June 15 the list of admissions made both under the 50 per cent all-India quota as well as under the State quota. The DGHS was directed to file a comprehensive affidavit giving details of the admission by July 15 and the Bench directed listing of the matter for further hearing in August.
