Court notice to Jharkhand Speaker

RANCHI:
The Jharkhand High Court on Thursday sought an explanation from the Speaker of the Legislative Assembly, Inder Singh Namdhari, for not taking action against the Jharkhand Party MLA, Enos Ekka, under the Anti-Defection Act.
Taking up a petition filed by the Jharkhand Party president, N.E. Horo, for disqualifying Mr. Ekka under the Anti-Defection Act, the Court of Justice M.Y. Iqbal ordered notice to the Speaker asking why action was not taken so far against Mr. Ekka under the relevant Act. Directing the Speaker to reply within a week, the Court posted the case for next hearing on April 28.
The petitioner contended that since Mr. Ekka had joined the ruling BJP-led NDA Government in the State in a clear defiance of the whip issued by the Jharkhand Party president to lend support to the United Progressive Alliance-led opposition in the State, he should be disqualified. Mr. Ekka was allegedly kidnapped by the BJP to foil the abortive attempt by the erstwhile UPA-led Shibu Soren Government to survive the vote of confidence on the floor of the House. The Soren Government was short of one MLA to prove its majority in which it had failed after Mr. Ekka preferred to vote in favour of the NDA.
