NEW DELHI: The Delhi High Court on Tuesday asked the Municipal Corporation of Delhi (MCD) Commissioner and the Land Acquisition Collector to file a report about the title on a 1,500 square metre playground of an MCD school at Shakarpur in East Delhi. A Division Bench of the Court comprising Justice B.C. Patel and Justice S.K. Kaul issued the direction to the Municipal Commissioner and the Land Acquisition Collector on public interest litigation by the Shakarpur School Block (I&II) Residents Association. The Bench asked the two officials to file their respective replies to the Court by August 13. In the petition filed through its counsel, S.S. Lingwal, the petitioner accused three private persons - Santosh Chhabra, Subhash Chhabra and Darshan Lal - of conniving with certain MCD officials and getting the title deed of the said land bearing khasra No. 183 transferred to their names by forging the relevant documents. The petitioner further stated that on the basis of the alleged false, forged and fabricated documents, the local body had also approved a building plan on the land in gross violation of the building by-laws and for extraneous reasons. The Gram Sabha of Shakarpur Khas village had in 1961 transferred 22 bighas of land to the Education Department of the local body for setting up a school, the petition said, adding that, thereafter the said land was acquired by the Union Government and it had handed it over to the then Delhi Administration in 1972. It further said that the remaining portion of the land measuring 8 bighas 13 biswas of khasra No. 183 was left out as the school building stood on it. Due to construction of a road later by the Municipal Corporation, the school premises got divided into two portions, school building and the playground, the petition stated, adding that since the playground abutted on the road leading to Vikas Marg, property dealers and builders of the area, including the three private persons, were trying to grab it. The petitioner urged the Court to order restoration of the ownership of land to the school and issue appropriate directions for initiating action against the responsible local body officials.
