Judicial ascendancy

The article "Can judicial ascendancy be rolled back?" (April 29) is excellent. But while judges need to exercise restraint to avoid erecting their prejudices into principles, does not the executive also need to exercise greater wisdom and restraint?

Judicial activism is the result of executive and legislative apathy. It was only when the executive did not or could not effectively tackle issues such as river water sharing, air pollution, smoking in public places, and protection of women in the work place that the Supreme Court provided the solution.

As long as our political leadership does not reform, a pro-active judiciary is the only recourse for the common man.

The judiciary is the only pillar of democracy that has been left largely unblemished. It gives an answer to the common man on the socio-economic problems he faces in day-to-day life, whether it has to do with smoking in public or environment-related issues. Judicial activism is one of the most important arrows in the common man's quiver.
