HC ruling on increment

The Madurai Bench of the Madras High Court recently directed the Hindu Religious and Charitable Endowments Department to pay the increment arrears of an employee since 1991, on the ground that an employee cannot be deprived of his right to earn an increment merely because a charge memo was pending against him for 14 years.

Observing that a reasonable presumption could be drawn that the department was not interested in pursuing the matter since the memo was pending for a long period, Justice D. Murugesan directed the authorities to sanction the annual arrears within a period of eight weeks and to pay future increments without any default. — Staff Reporter
