BANGALORE: The Karnataka High Court on Thursday ordered issue of notices to the State Government, the Rajiv Gandhi University of Health Sciences (RGUHS) and other respondents on a petition by Nitte Education Trust of Mangalore seeking quashing of the Government Order specifying the seat matrix and fee structure for professional courses in the State. The trust and A.B. Shetty Memorial Institution of Dental Sciences, Mangalore, were challenging the Karnataka Conduct of Entrance Test for Admission to Postgraduate Medical and Dental, Degree and Diploma Courses Rules (2003). They were also challenging the April 15, 2005 notification by the Department of Health and Family Welfare stipulating the seat matrix and fee structure for medical and dental courses this year. The A.B. Shetty Institution said it was classified under linguistic minority category, and for 2005-06 it had admitted 25 per cent of the students from the linguistic minority group on the basis of the COMED-K (Confederation of Medical, Engineering and Dental Colleges of Karnataka) test. It said it was entitled to fill 80 per cent of seats in accordance with the Dental Council of India Act and MDS Regulation.
`Students admitted'
It said it had already admitted some students and others were in the process of being admitted. The fee proposed by it was being scrutinised by the Fee Fixation Committee headed by the retired Judge, Rangavittalachar, when the Government "arbitrarily" notified the fee structure and the seat matrix. The petitioners urged the court to set aside the April 15 notification and allow it to admit students. A Division Bench, comprising Justice H.L. Dattu and Justice A.C. Kabbin, ordered issue of notices to the State Government, the Department of Health and Family Welfare, Department of Medical Education and RGUHS. The Bench adjourned further hearing of the matter.
