NEW DELHI: : The Delhi High Court on Thursday summoned in person an Additional Deputy Commissioner of Police (DCP), South District, and the Station House Officer (SHO) of the Defence Colony of the Delhi police on an allegation by the Delhi Development Authority (DDA) that the city police had refused to make available police force to assist it in the removal of encroachments and unauthorised constructions on one of its land in Masjid Moth area. A Division Bench comprising Justice B.C. Patel and Justice S.K. Kaul directed the two officials to be present before the Court in person on May 11 and explain the allegation levelled by the Authority. The Bench had in February this year directed the DDA to take action within three weeks against the encroachments and unauthorised constructions and file a report, failing which the DDA Commissioner concerned would in person appear before the Court. The DDA in its affidavit filed on May 2 informed the Court that it had planned demolition of a multi-storey building having 32 flats built on the land and fixed March 8, 28, 31 and April 27 as the dates for carrying out the job, and the local police were informed about the schedule in advance, but they failed to provide any assistance saying that it was not clear whether the encroachments were on khasra no. 115 or 125 and that there was an apprehension that there would be resistance from public who might disrupt the demolition operation. The DDA further said that it had repeatedly clarified to the police that the encroachments were on khasra no. 125, not on khasra no. 115.
