NEW DELHI: : The Delhi High Court on Friday dismissed as withdrawn the bail application of R.K. Sharma, prime accused in the Shivani Bhatnagar murder case and suspended Inspector-General of Prisons, Haryana Police. Counsel for the petitioner, Rana Praveen Siddiqui, sought and got permission from the Court to withdraw the petition when she heard from Justice B.D. Ahmed during the hearing that her client "will not get bail'' as there were no changes in the circumstances of the case when the Court had last time rejected his bail. However, Mr. Justice Ahmed mentioned in his order that the prosecution would finish the recording of evidence of the remaining 34 prosecution witnesses by August-September this year failing which the petitioner would be at liberty to move the Court for bail. Mr. Justice Ahmed passed the order when the Special Public Prosecutor (SPP) in the case, S.K. Saxena, submitted that he hoped that the recording of evidence of the prosecution witnesses would be over by August-September. Mr. Saxena submitted that the trial was going on expeditiously as per the directions by another Bench of the High Court. He submitted that there were a total of 230 witness of which 178 had been so far been examined and 18 had been dropped during the course of trial. Ms. Praveen sought bail for her client on the ground that there was no case against him as no prosecution witnesses so far examined had indicated directly or indirectly his involvement in the crime. However, Mr. Justice Ahmed was not convinced by her submission on the point of changes in the circumstances of the case since the rejection of bail of the accused last time as claimed by her. Sharma and his five co-accused are facing trial for criminal conspiracy read with murder for allegedly killing the then Indian Express Principal Correspondent, Shivani Bhatnagar, at Navkunj Apartments at Patparganj in East Delhi in 1999.
