LUCKNOW: Udai Bhan Singh, Samajwadi Party MLA from Aurai in Uttar Pradesh, has been convicted in a murder case. The MLA could be debarred for six years from contesting elections after he completes his conviction term, even if he was disqualified from the membership of the State Legislative Assembly by the EC. According to sources, legal process was being finalised by the EC on disqualification of Singh, who is currently lodged in Varanasi Central Jail. A final decision in this regard has to be taken by the Governor T.V. Rajeswar, who is said to be waiting for EC's formal opinion on the issue. The Governor is empowered to initiate disqualification proceeding under section II of the Article 192 after obtaining the opinion of the EC. In accordance with this, the governor had referred the matter for the EC's opinion on March 28. Earlier, a representation to this effect was submitted to the Governor by petitioner Sarvesh Narain Shukla on March 14. Shukla had moved a petition against Udai Bhan Singh, who was subsequently declared a murder convict by the trial court of Bhadoi in Sant Ravi Das Nagar district on April 4 in 2004. The Allahabad High Court had confirmed conviction of the SP MLA on January 28 this year and had directed that the disqualification proceedings be initiated against him by an appropriate authority. -- UNI
