High Court reverses trial court order

NEW DELHI: The Delhi High Court on Monday reversed a trial court order deferring the cross-examination of prosecution witnesses in the Shivani Bhatnagar murder case till completion of recording of their evidence.

Reversing the order of the Additional Sessions Judge, Sunil Gaur, Justice H.R. Malhotra said the cross-examination of a prosecution witness in the case should be taken and concluded on the day of recording of his evidence or next day.

Mr. Justice Malhotra further stated that the deferring the cross-examination for a long would give birth to complications in the case.

He directed the lower court conducting trial to schedule the dates of recording of evidence of the prosecution witnesses in the light of the order. The High Court order came on a revision petition by the prosecution in the case. R K.Sharma, a suspended IPS officer, along with five co-accused are facing prosecution for allegedly hatching a conspiracy and killing the Indian Express Principal Correspondent, Shivani Bhatnagar, at her Navkunj Apartments in Patparganj in East Delhi in 1999.
