MADURAI: The Madurai Bench of the Madras High Court on Thursday granted anticipatory bail to a Joint-Director of Health Services and two other women Government doctors accused of culpable homicide (causing death but not amounting to murder). The Dindigul Town North police station had registered the case against J. Amaladevi, Joint-Director in Chennai, N. Umadevi, Municipal woman medical officer and Kaliammal, a doctor attached to the Government Hospital in Dindigul. According to Dr. Amaladevi, while working in Dindigul, on August 2 last, she along with the other doctors operated on a woman for removing a tumour. During the surgery, cancer secondaries were found in the body of the patient and her uterus was removed. She was discharged from the hospital on August 15 and subsequently died on November 11. Later, the husband of the deceased preferred a complaint with the police and a case was registered against the doctors. The counsel for the petitioners, T. Lajapathi Roy, said, the deceased died because of `sarcoma', a deadly form of cancer and not due to the surgery and alleged that the husband of the deceased demanded a huge sum of money to restrain from preferring a false complaint against them. He also cited a Supreme Court judgement in 2004 and said that criminal liability cannot be fixed against doctors.
