Writ petition on castle admitted

Notice to State Government

KOCHI: The Kerala High Court on Thursday admitted a writ petition filed by M Far Hotels Limited challenging the Government order for taking over the Halcyon Castle and its surrounding buildings and land at Kovalam on the grounds of its historical importance. Justice K. Balakrishnan Nair while admitting the writ petition also issued notice to the State Government and other respondents. The hotel group contended that the Government had no power to take over the castle. It had been taken over on the false assumption that the Regent Maharani Sethulakshmibai had established the castle. The castle was only a guesthouse. Therefore, it could not be regarded as an historical site. The petitioner alleged it had been singled out in this regard.

It said that as many as 3,269 sites of historical importance had been identified. The Government had not taken any steps to declare them as ancient monuments. So, the order was discriminatory. Moreover, the Government lacked legislative competence. The order was issued under extraneous consideration. It was promulgated following the High Court verdict quashing an earlier takeover order. The petitioner also pointed out that the new order was violative of the earlier High Court directions.

Vigilance report sought

A Bench comprising the Chief Justice, Rajiv Gupta, and Justice K.S. Radhakrishan on Thursday directed the Government to produce the report of the Vigilance inquiry into the allegations of irregularities in the Kerala State Civil Supplies Corporation. The court issued the directive on a writ petition seeking a CBI inquiry into the allegations of corruption in buying medicines, spices and so on during the tenure of S. Pulikesi as managing director of the corporation.
