NEW DELHI: Four former members of the Bihar Assembly filed a petition in the Supreme Court on Monday challenging the Presidential order dissolving the House. They sought a direction to quash the May 23 order and to restore the Legislative Assembly to enable the formation of a popular government. The petitioners Rameswar Prasad Chourasia (Bharatiya Janata Party), Anil Kumar (Lok Jan Shakti Party), Ram Pravesh Rai (Janata Dal-United) and Kishore Kumar (Independent) said the Centre's decision to dissolve the Assembly was unconstitutional. They alleged that the action of Governor Buta Singh in recommending dissolution of the House was mala fide.
"Unconstitutional move"
They said that it was incumbent upon the Governor to invite the leader of the largest single formation to form a government and test his majority on the floor of the House. "The fact that there is a dissolution of an Assembly within 79 days of its creation without any meaningful effort to explore the possibility of formation of a popular government itself makes the move unconstitutional," they contended.
