NEW DELHI: The Supreme Court on Friday issued notice to the Centre on a petition questioning the applicability of the scheme for admission to post-graduate medical courses in government colleges across the country to deemed universities also. A vacation Bench of Justice P. Venkatarama Reddi and Justice Arijit Pasayat issued notice to the Union Health Secretary and the Medical Council of India returnable in one week on the petition filed by Vinayaka Mission's Research Foundation (Deemed University). The Bench gave liberty to the petitioner to mention before another vacation Bench for further listing of the matter. The petitioner submitted that the apex court while dealing with the case relating to all-India quota seats had directed the States to adhere to the time schedule for admissions and intimate the vacancies after July 18 and latest by July 25. The petitioner said it was a deemed university running two medical colleges one in Salem, Tamil Nadu and another in Karaikal in Pondicherry. The petitioner submitted applications to the Medical Council for starting post-graduate degree and diploma medical courses in the two colleges along with the Essentiality Certificate issued by the State governments. Inspection was conducted in April and the petitioner was awaiting the nod from the Council for the commencement of the courses from the academic year 2005-2006. But the Council decided to consider the proposal only for the next academic year on the ground that the last date for completing the admissions was already over on May 31. The petition said the Council had erroneously interpreted the apex court judgment that it would apply even to a deemed university when it specifically dealt with all-India and State quotas in government medical colleges. The petitioner sought a direction to the respondents to forthwith grant necessary permission for starting the post-graduate courses from the academic year 2005-2006 itself on the basis of the inspection conducted by the Council to enable the institutions to admit students.
