KOCHI: The National Guidelines for Accreditation, Supervision and Regulation of Assisted Reproductive Technology (ART) Clinics deal with the issue of paternity, succession, donor ova and sperm and so on in infertility treatment, according to an affidavit filed by the Union Ministry of Health and Family Welfare before the Kerala High Court on Wednesday. The affidavit was in response to a writ petition filed by Anitha Jayadevan, and others, seeking a directive to the Union and the State governments to impose restrictions on the use of donor ova, sperm or embryo in ART. The affidavit said the guidelines prepared by the Indian Council of Medical Research (ICMR) had been approved by the Ministry. They stipulated that the consent of both partners was a necessary pre-condition for treatment of infertility using donor ova, or sperm. The guidelines provided for written consent of the couple. There was also a model consent form. Fertilising with donor semen, or ova, was an ethically acceptable procedure, provided there was a medical indication and psychological confirmation of its use. The affidavit said the scientific advance in the medical field had paved the way for ART clinics. The affidavit, filed thorough Assistant Solicitor-General John Varghese, said the increase in number of infertility clinics in the country was the direct result of increasing incidence of infertility. There was no reliable information regarding the number of such clinics in the country.
