KANCHEEPURAM: G.M.Akbar Ali, District Sessions Judge, has posted the Sankararaman murder case for July 12 for framing of charges. When the case came up for hearing on Thursday, the Judge ascertained from the accused persons including Sri Jayendra Saraswathi and Sri Vijayendra Saraswathi who were present at the court whether they had engaged counsels to defend them, and if not, whether they needed any assistance. After confirming that each accused person has availed himself of the services of legal practitioners, the Judge informed them that charges would be framed against them in connection with the case on July 12. Earlier, petitions under sec.317 of Cr.P.C. seeking dispensation from their personal appearance in the court were moved on behalf of Sundaresa Iyer, Kanchi Mutt manager, and Raghu, brother of the junior Acharya. The defence counsel, led by K.S. Dinakaran, said that both Mr. Iyer and Mr. Raghu were not able to appear on Thursday since they had to comply with the directions by the Madras High Court in its bail order. While Mr. Iyer was directed to stay at Villupuram and sign at the local police station every day, Mr. Raghu was asked to remain at Coimbatore and sign at the local police station twice a day. Hence the petition, they added. Objecting to the petitions, the Special Public Prosecutor, Balasundaram and Chengalpattu Public Prosectuor, K.Arumugham, pointed out that it was the bounden duty of those who were on bail to appear before the court concerned whenever the case in which they were involved was listed for hearing. However, the Judge, after going through the bail order of Mr. Raghu said that since both the accused persons had to comply with the Madras High Court bail conditions, the lower Court accepted their dispensation petition. At the same time, Mr. Akbar Ali directed both the prosecution and defence counsel to get necessary clarification in this regard from the Madras High Court before the next hearing date.
Anticipatory bail
Meanwhile, the Judge granted anticipatory bail to Sri Vijayendra Saraswathi with regard to "Tampering of Mutt Accounts" case. Pronouncing the order in the open court, the Judge said anticipatory bail granted to the petitioner would be on the lines of the anticipatory bail granted to the Senior Acharya by the Madras High Court in the same case.
