Ilavarasi moves court for clarifications

CHENNAI: J. Ilavarasi, an accused in the Rs. 66.65-crore disproportionate wealth case against Chief Minister Jayalalithaa has moved the Madras High Court seeking certain clarifications in an order passed over two years ago.

Counsel for Ms. Ilavarasi moved the petition, obtaining leave from the portfolio judge. The petition is likely to come up for hearing on Monday.

The clarification pertains to whether there ought to be a consolidated hearing of the disproportionate wealth case and the London Hotels Case or the cases are to be heard separately.

The Income Tax Commissioner of Chennai (Central II) Circle filed a writ petition in the High Court, challenging an Income Settlement Commission order on Ms. Jayalalithaa's non-filing of income tax returns for the assessment year 1989.The Additional Bench of the Commission here passed the impugned order on February 17, 2005, on an application (600/C/II/3/2004) filed by Ms. Jayalalithaa. In his present petition, the IT Commissioner wanted the court to call for the records of the Commission and quash the February 17 order.

He sought to forbear the Commission from taking up the application and continuing with the hearing.

This petition will come up for hearing on Saturday.
