Petitions of Lalu, Rabri dismissed

PATNA: The Patna High Court on Tuesday dismissed the petitions of RJD chief and Railway Minister Lalu Prasad and the former Bihar Chief Minister, Rabri Devi, challenging the sanction of prosecution in the disproportionate assets case, paving the way for the lower court to pronounce its ruling after concluding the hearing.

Full judgment awaited

The three-member Bench of Justice R.N. Prasad, Justice Barin Ghosh and Justice M.L. Visa turned down the petitions without assigning any cause in the one line order read out in the court. The full judgment is still awaited. The Bench reserved its order on May 18 when the hearing had concluded.

In 2000, Mr. Lalu Prasad challenged the sanction ordered by the Governor saying that it was defective and only the Cabinet could have taken the decision, while his wife contended that no sanction had been obtained for her prosecution even though she happened to be the Chief Minister when the charge sheet had been filed.

Curtains down

Tuesday's order brings the curtain down on a five-year case which saw the Supreme Court's intervention. The case was heard twice in the High Court and the apex court then constituted a two-member Bench to dispose of the case, but later revised its order and accepted the contention of the petitioners that the High Court alone had the power to constitute the Bench.
