BANGALORE: The Law Department, which has been flooded with requests from other departments seeking its opinion on the process of de-notification of land acquired by them, has said there is no provision under the Land Acquisition Act to reverse the notification of acquisition once the Government has taken possession of the land. The Law Minister, H.K. Patil, told presspersons here on Monday that Sections 15(A) and 48(1) of the Act have made it clear, but the various departments have been seeking clarifications from the Law Department. According to the law, and following Supreme Court orders in relevant cases, land once acquired cannot be returned to the original owner but can be diverted for other purposes by the Government, or put up for auction or sale, Mr. Patil said. Mr. Patil said the circular applied to all cases of acquisition of land anywhere in the State, and it is being issued as a clarification.

He refused to respond to questions on how that will affect the issue of the 2,000 acres of land acquired in excess of requirement for the Bangalore-Mysore Infrastructure Corridor project or the Bangalore international airport project, where about 450 acres has been found to be in excess of requirement.
