Interim stay on DRT order

CHENNAI:
The Debt Recovery Appellate Tribunal, Chennai, has granted interim stay of an order of the Debts Recovery Tribunal-II, Chennai, directing Tamilnad Mercantile Bank to restore possession of immovable property belonging to Leela Agencies and Leela Traders, borrowers from the bank.
Justice K.Gnanaprakasam, Chairperson of the Appellate Tribunal, granted the interim stay on June 21, 2005, on an appeal filed by the bank and ordered issue of notice returnable by July 11, 2005.
The appellant had submitted that the property involved in the case was a residential house and that the bank had taken only symbolic possession of the property and as such no hardship or prejudice would be caused to the respondent if the order passed by the DRT-II Chennai was stayed.
