Riots: CBI pleads inability to register FIR against Modi

NEW DELHI: The Central Bureau of Investigation (CBI) is learnt to have conveyed to the Centre its inability to register a case against Gujarat Chief Minister Narendra Modi, the State Government and other key senior officials for their alleged complicity in the March 2002 riots in Gujarat.

Highly-placed government sources said the agency had conveyed its views to the Ministry of Personnel and Public Grievances, the nodal ministry that administratively controlled the CBI.

The Centre, sources said, was of the view that there was enough evidence for registering a First Information Report (FIR) against Mr. Modi, the State Government and others in the personal diaries of R. Sreekumar, a senior IPS officer and Gujarat police official.

Mr. Sreekumar, who was intelligence chief during the Gujarat riots, had stated before the Central Administrative Tribunal that Mr. Modi and key administration officials of the State Government were involved in the violence during the 2002 Gujarat riots.

The Central Government felt it was enough for the agency to have registered an FIR but the CBI said that the law did not allow it to directly register a case without the sanction or request of the State Government or a court directive, sources said.
