Court not to interfere in judge's transfer

CBI is probing disproportionate assets cases against Lalu Prasad

NEW DELHI: The Supreme Court on Monday expressed its difficulty to interfere with the Patna High Court's decision to transfer the CBI Judge, who was trying the disproportionate assets cases against Railway Minister Lalu Prasad and his wife and former Bihar Chief Minister, Rabri Devi.

A vacation Bench comprising Justice D.M. Dhrmadhikari and Justice S.H. Kapadia refused to pass any interim orders on the petition filed by Janata Dal (United) MP, Rajiv Ranjan Singh "Lallan," challenging the proposed transfer.

Appearing for the petitioner, senior counsel Mukul Rohatgi said that during the hearing of an earlier petition, he was apprehensive that the Judge trying the disproportionate assets case would be transferred.

However, the Bench said it had come to its notice that the Judge was being transferred on promotion.

"If that is the case, how can he be prevented from taking promotion and how could the apex court interfere in the administrative decision of the High Court to promote him," the Bench said and directed listing of the petition after the summer vacation.
