High Court upholds reservation for Mayor's post

MYSORE: With the Karnataka High Court upholding the State Government's decision reserving the Mayor's post to candidates from the Scheduled Tribes, the decks have been cleared for the election of the Congress corporator, Bharathi, to the post.

When the petition filed by the independent corporator Bharatesh came up for hearing in the High Court on Tuesday, Justice Ram Mohan Reddy refused to stay the Mayoral elections scheduled for June 30.

According to sources, Mr. Bharatesh prayed to the court to stay the election proceedings and direct the State Government to reserve the post to candidates from the Scheduled Castes.

But the Advocate-General, B.T. Parthasarathy, who appeared for the State, defended the Government's decision and contended that the post of the Mayor has not been reserved for a Scheduled Tribe candidate during the present tenure of five years either in Mysore or elsewhere in the State.

Further, he argued that the Government has given ample opportunities for Scheduled Caste candidates this year as well as on previous occasions in different corporations.

`Historic decision'

Mr. Parthasarathy went on to describe the Government's move to reserve the coveted post to Scheduled Tribe candidates as a "historic decision."

He said the candidate for the post in Mysore is an educated and intelligent woman coming from a weaker section. But advocate Ranga Reddy, who argued for the petitioner, said the Government has not strictly followed the roster system in the Mysore City Corporation during the present tenure of five years. "No candidate from the Scheduled Castes has been given the opportunity to become the Mayor of Mysore during this term," he said. He prayed that the post be reserved for Scheduled Caste candidates at least during the last year of the term.

Mr. Reddy also told the court that the population of Scheduled Tribes is only 2,000 in Mysore City.

However, Mr. Justice Reddy ruled that the Government's decision to reserve the post for a candidate from Scheduled Tribes is legal.
