MADIKERI: The revenue from stamp and registration fees in Kodagu district has declined ever since the State Government made it mandatory for the seller and a few other categories to produce "conversion certificate" relating to the property from agricultural land to non-agricultural before the registering authority. There has been no registration since May 10, 2005 in Kodagu. The gazette notification copy was received by the District Registrar here on May 9. Revenue has come down by nearly 50 per cent over the corresponding period last year since the implementation of the order, the District Registrar, K.N. Uthaiah, said. He told The Hindu that the target for stamp and registration fees for Kodagu in the previous year was Rs. 8 crores. The new rule requires production of the alienation certificate (conversion from agricultural to non-agricultural use) before the registering authority pertaining to sale, gift, exchange, mortgage, agreement to sell, lease or assignment or otherwise of a site with or without building on an agricultural land which is not converted for non-agricultural purposes under Section 95 of the Karnataka Land Revenue Act of 1964. The move was necessitated as the Government learned that registrations of properties based on fabricated and bogus records was taking place, particularly in and around cities and towns.
Supreme court ruling
The Supreme Court has ruled that the purpose of Section 95 is to prevent indiscriminate conversion of agricultural land and a regulation is needed to check such a development. The notification will not apply to Ashraya, Ambedkar, Indira Avas Yojana, Peoples' Housing Scheme, HUDCO, Bhagyamandira and similar schemes of the Government through which sites and buildings are transferred by panchayats, municipal authorities, urban development authorities, Rajiv Gandhi Housing Corporation, the Karnataka Industrial Areas Development Board, the Karnataka Small Scale Industries Development Corporation, and the Karnataka Housing Board.
Target
Kodagu district was given a target of Rs. 8 crores revenue in 2004-05 from four the sub-registrar's offices in Madikeri, Virajpet, Ponnampet and Somwarpet, apart from the District Registrar's office here. But the collection last year was Rs. 8.61 crores. As many as 5,780 documents were received for registration. Of the revenue, Rs. 7.74 crores was collected by way of stamp duty and remaining amount from registration fee. The revenue target for 2003-04 was Rs. 7.24 crore and the collection was Rs. 6.90 crores. The target for this year is Rs. 11 crores, he said. In the three months of this year, Rs. 1.98 crores has been collected, Mr. Uthaiah added.
