HYDERABAD: The elections of the Andhra Pradesh Wakf Board have been stayed by a Division Bench of the High Court. The Bench, comprising Justice A. Chamalameshwar and Justice M. Venkateswara Reddy, was dealing with a writ petition filed by the association of Andhra Pradesh Sajjad Nashins Muthavali Kidert Guzara of Wakf on Wednesday. The petitioners initially filed the writ complaining against the rule by which the members of managing committee of Wakfs were allowed to contest for the Wakf Board under a separate electoral college. They initially obtained a stay, which prevented the members of the managing committee to contest for the Wakf Board from the electoral college meant for them. Implead and vacation stay petitions were filed. After hearing both the parties at length, the Bench felt that the issue needs serious consideration and election at this stage would not be proper and stayed the elections and ordered that the writ petition be heard expeditiously.
Writ petition dismissed
The writ petition filed challenging the mode of election to the Wakf Board from the Andhra Pradesh Bar Council and election of Naushad Ali has been dismissed by a Division Bench of the High Court on Wednesday. The Bench comprising of acting Chief Justice Bilal Nazki and Justice G. Chandriah was dealing with a writ petition filed by one, Ameena Begum. She said that the rules provide for election of an advocate from the Muslim community to be elected from the electoral college comprising of members of the Bar Council. She said that all advocates from the Muslim community in the State comprise the electoral college, but not the elected member of the Bar Council. The Government informed the court that all the advocates are merely enrolled but only 25 members are elected to the Bar Council and the persons from Muslim community amongst these 25 members would be comprising the electoral college.
Lone member
Mr. Naushad Ali is presently the lone member elected to the Andhra Pradesh Bar Council and he has been declared member of the Wakf Board and the present writ petition filed challenging this, has been dismissed.
