AIBA threatens boycott over Cr.P.C. changes

NEW DELHI: The All India Bar Association has threatened a countrywide boycott of courts by lawyers if the amendments introduced in the Criminal Procedure Code were not withdrawn by the Union Government immediately.

In a statement, the chairman, Adish C. Agarwala and vice chairman, S. Prabhakaran said many suggestions recommended by the Justice Malimath Committee and sought to be implemented by the Centre would virtually take away the existing rights and liberty of an individual facing criminal trial all over the country.

They said advocates in Tamil Nadu had protested against the new amendments. Lawyers in the Patiala court in the capital struck work on July 8. The agitation is spreading to other parts of the country since lawyers were concerned about the `draconian nature' of the amendments.

The Centre was reportedly contemplating withdrawing the notification regarding the amendments and a decision was expected by July 13. In view of this the AIBA urged lawyers to defer their strike plan for a few days. But it warned that they would go on a boycott if the Government did not act.

Mr. Agarwala said the AIBA planned to meet President A.P.J. Abdul Kalam and request him not to give assent to the proposed amendment Bill and also to meet Chief Justice of India R.C. Lahoti, seeking his intervention.

Giving the executive judicial power was unheard of in criminal jurisprudence, the AIBA said and urged the Government to act immediately on the demands of the lawyers.
