Railway Board asked to complete election process

CHENNAI: Relying on an August 2004 order of the Supreme Court, the Madras High Court has directed the Railway Board to complete election process for all levels of the All-India SC, ST Railway Employees Association.

Passing orders on two petitions from K. Srinivasan, the First Bench comprising the Chief Justice Markandey Katju and Mr. Justice F.M. Ibrahim Kalifulla said: "We direct that the election process should be completed expeditiously as already directed by the Supreme Court by its order dated August 9, 2004, and by the First Bench of this court by an order dated May 5, 2004."

It said parties aggrieved by the election proceedings of results could challenge it after the results were declared.

It further said:

"Once the election process has started the court should ordinarily not interfere, and the election process should be completed and the results should be declared. Only thereafter any party aggrieved can challenge the election either by way of election petition or by filing a civil suit or by some other proceedings."
