Lawyers meet Manmohan

NEW DELHI: Prime Minister Manmohan Singh on Tuesday assured a delegation of lawyers, accompanied by Union Ministers, including Dayanidhi Maran, that he would look into their grievances relating to the Code of Criminal Procedure (Amendment) Act, 2005, which got the President's assent on June 23.

The lawyers' delegation led by the president of the Madras High Court Advocates Association, S. Prabhakaran told the Prime Minister that the amendments violated the basic principles of criminal jurisprudence and took away the little safeguards available to an accused.

Besides Mr. Maran, two DMK Ministers in the UPA Government, S. Raghupathi and K. Venkatapathy and Congress member of Parliament S.K. Karventhan accompanied the lawyers. The delegation urged the Prime Minister not to give effect to the Amendment Act. The new amendments were not only `draconian in nature' but would also `affect' the spirit of criminal jurisprudence.

Later talking to reporters, Mr. Prabhakaran said the Prime Minister shared their concern and had assured them that he would talk to the Home and Law Ministers and do the needful. The lawyers also met Home Minister Shivraj Patil and Law Minister H.R. Bhardwaj cited the `harsh provisions' of the new Act and urged them to defer the implementation. Lawyers across the country in general and in Tamil Nadu in particular are aggrieved over the amendments to Section 438 Cr. P.C. relating to anticipatory bail; Section 20 (conferring power on District Magistrates); Section 25-A (establishment of Directorate of Prosecution); Section 358 (enhancement of fine upto Rs. 1,000); Section 377 (providing an appeal to High Court); Section 378 (Magistrates to direct Public Prosecutor to present an appeal) and Section 389 (power of Public Prosecutor to seek cancellation of bail).
