The Association said an amendment to Section 438 of the Criminal Procedure Code would in effect do away with the anticipatory bail provision. The amendment required those seeking anticipatory bail to appear in person before the court when the petition was taken up for hearing. As a result, they will be forced to go to jail in case the court rejected the bail plea. Moreover, it will also take away the right of the litigant to go in appeal before the High Court against the lower court order. The proposed amendment to Section 324 will scrap the power of the police to grant bail in certain cases.— Staff Reporter
