Medical colleges: Court seeks report from State, MCI

Legal Correspondent

Interim orders passed in response to writ filed by junior doctors

HYDERABAD: A Division Bench of the Andhra Pradesh High Court on Monday called for authenticated reports from the State Government and Medical Council of India (MCI) regarding availability of qualified staff and required infrastructure in the newly set up medical colleges, specifically named by junior doctors in the new writ petition, within two weeks.

These interim orders were passed by the Division Bench comprising acting Chief Justice Bilal Nazki and Justice G. Chandraiah in response to a writ petition by junior doctors that the Government had not acted fairly in taking steps as per recommendations of the committee headed by Justice Jeevan Reddy.

The junior doctors suspended their agitation on Friday morning.

The Bench felt that it was also equally agitated about the lack of facilities but reminded the counsel for junior doctors Bojja Tarakam that stay of admissions or any such serious order would have to be passed only after due process of law.

The Bench made it clear that as the MCI had already given it's approval and the State Government had issued the essentiality certificates, hasty steps could not be taken. The Bench said that the report of the Jeeven Reddy committee could be a starting point but cancellation, stay, etc. could not be granted solely on the basis of the report.

Experts to visit colleges

The Bench directed the MCI to see that experts visited Shadan, Shaffi, Mother Theresa, Jogipalli BR Educational Trust Medical Colleges and submit a report about the staff, teaching hospital, and infrastructure. This should be without reference to the earlier reports.

The Bench directed the State Government to submit a report about the lack of infrastructure, inadequacy of staff in the teaching hospitals attached to Government medical colleges and the steps taken to rectify the situation. The case is listed after two weeks.
