THIRUVANANTHAPURAM: A memorandum signed by 114 MLAs seeking protection to the rights of PDP chairman Abdul Nasir Maudany, who has been languishing in the Coimbatore Central Prison for the last seven years, was submitted to President A. P. J. Abdul Kalam on Thursday. The memorandum, signed by members cutting across party lines, was submitted to the President by Parliamentary Affairs Minister Thiruvanchoor Radhakrishnan after the President addressed the members of the Assembly. The President said he had received a similar memorandum from Maudany's family members and promised him (Mr. Radhakrishnan) that the matter would be looked into, the Minister later told reporters. The memorandum points out that there was no end in sight for the trial in the Coimbatore blast case, in connection with which Maudany was arrested on March 31, 1998, and that the founder-chairman of the People's Democratic Party (PDP), whose right leg had been amputated earlier, was suffering from acute diabetes and hypertension. The prosecution, the memorandum says, was filing repeated applications to prolong the trial. The court had also rejected several bail applications without any direction to expedite the trial. The memorandum points out that Maudany's continued detention would be in clear violation of the Supreme Court's oft-repeated position that keeping anyone in prison without trial for unduly long periods would amount to infringement of the rights guaranteed under Article 21 of the Constitution. It also accuses the Tamil Nadu Government of having adopted a highly vindictive attitude towards Maudany of having imposed serious restrictions on him, including barring of visitors, denial of proper medical care and rejection of parole applications. The Kerala MLAs have requested the President to direct appropriate authorities to take steps necessary to protect Maudany's rights.
