CHENNAI: A Home Department order compulsorily retiring a district munsif-cum-judicial magistrate has been quashed by the Madras High Court on the ground the impugned order was not passed by the "appropriate authority." A Division Bench comprising Justice Prafulla Kumar Misra and Justice S.R. Singharavelu passed the order on a writ petition filed by D. Kulasekaran, who was appointed magistrate in August 1992 through recruitment by transfer method. Over nine years after his appointment, Mr. Kulasekaran told the Law Department that he wanted to return to it after three more years with the judiciary.
