Stay vacated in
Serija Banu case
The Bench had last year admitted a criminal revision petition moved by the accused and granted an interim stay of all further proceedings. According to the accused, the post of presiding officer in the Special Court for narcotics cases was vacant and hence the Principal District and Sessions Judge was placed in full additional charge. Claiming that a judge cannot hold additional charge as per Section 36 of Narcotics and Psychotropic Substances (NDPS) Act, they objected to the trial. Stating that the main revision petition could be decided only later because it involved an intricate question of law requiring elaborate arguments, Justice S.R. Singharavelu vacated the stay and posted the revision petition after a month. Staff Reporter
