High Court disallows take over of school

NEW DELHI: The Delhi High Court has disallowed a petition challenging the takeover of a private school at R.K. Puram by the Directorate of Education following a dispute among the trustees of the school.

The Directorate had in 1996 taken over the management of Central Academy Senior Secondary School, set up and run by the Children's Education Trust of India.

The trust was established by two brothers, S.N. Chaturvedi and H.N. Chaturvedi, who later fell out and initiated litigation against each other over the legal representative of the voluntary body and its managing committee.

In another petition related to the case, the Parents-Teachers Association (PTA) of the school through its counsel, Rajiv Awasthi, resisted separate pleas by the two brothers urging the Court to hand over the management of the school to either of them.

Mr. Awasthi submitted that, as was the case for the past decade, the school should continue to run as a government school.

PTA's contention

The PTA also submitted that the Directorate of Education should inquire into the genuineness of the degrees and educational qualification of S.N. Chaturvedi and his son Ashok Chaturvedi.

However, Justice Vikramjit Sen ruled that there was no need to exercise the extraordinary jurisdiction of the court on such a matter. Persons aggrieved by any alleged forgery could take alternative legal recourse, he stated.

The PTA also urged the court to direct the authority concerned to withdraw the recognition accorded to the trust. However, the judge said the prayer had been answered with the cancellation of the lease and the running of school directly by the Directorate of Education.
