Dara Singh moves Supreme Court
Legal Correspondent
NEW DELHI:
Dara Singh, who was awarded life imprisonment by the Orissa High Court in the case of murder of Australian missionary Graham Staines and his minor sons Philip and Timothy, on Tuesday moved the Supreme Court.
In his special leave petition (SLP), Dara Singh said his conviction was upheld on the presumption of his presence at the scene of the incident at Manoharpur in Keonjhar district as a mob was shouting slogans in his name. Conviction based on presumption was contrary to the principle of criminal justice.
The High Court on May 19 set aside the death sentence imposed on Rabindra Pal Singh alias Dara Singh but slapped life imprisonment on him for being part of an unlawful assembly, which burnt alive the three.
