BANGALORE: The draft Bill of the State legislation on professional college admissions, appropriating 50 per cent of the annually permitted seats in each branch in unaided colleges for the Government, will be placed before the Education Ministers' conference on August 27. The State Government will receive public feedback on the draft bill till September-end, Law and Parliamentary Affairs Minister H.K. Patil said here on Saturday. The appropriated seats, according to the draft Bill, will be governed by the reservation policy of the State as applicable to backward classes and the Scheduled Castes and Scheduled Tribes. The claims of the students from Other Backward Classes and SC/STs, the Bill says, will also be considered for unreserved seats to be filled on the basis of merit. This will, however, not affect the number of reserved seats. Circulating the draft Bill to presspersons here on Saturday, Mr. Patil said the Bill will be enacted under 31(c) and 39 (b and c) of the Constitution. The seven-judge Constitution Bench of the Supreme Court, in its judgment on August 12, had inter alia held that appropriation of seats by the Government and enforcement of reservation policy in admissions to unaided private institutions could not be held as a reasonable restriction of the right to establish and administer educational institutions within the meaning of Article 19 (6) of the Constitution. Mr. Patil said the State legislation will be preceded by comprehensive discussions.
