Lahoti's reaction

The reaction of Chief Justice R.C. Lahoti — asking the Centre to wind up courts and do what it wants — to the Government's criticism of the Supreme Court ruling abolishing reservation in private, unaided colleges is understandable. In the name of social justice, the political parties are raising a furore over the judgment, calling for a Constitution amendment. The Government should confine itself to ensuring that admissions are transparent and that merit alone is considered. To provide a level-playing field, steps should be initiated at the grass roots and not at the level of higher education.

I fully agree with Justice Lahoti's observation that the Government might as well close all courts if it is not in a position to understand the essence of the judgment, and is bent on confrontation.

The Supreme Court judgment on reservation affords the Government and all those interested in the balanced development of society a chance to see how reservation has worked and bring about necessary changes. Surely, all sections have progressed since the introduction of reservation. The system must be reviewed to accommodate this reality. In private professional colleges, the Government's job is to see that they do not charge exorbitant fees, and that they conform to norms. The governments themselves must conform to the prescribed standards, providing quality teachers and laboratories in their colleges.

Quality cannot be compromised in education. The parties should remain content with reservation in government colleges. The Government can consider establishing more colleges and increasing the capacity in its existing institutions, instead of disrespecting the court verdict.
