NEW DELHI: The Congress on Tuesday termed the Supreme Court's observations in regard to the apex court's decision on `quotas and reservation' in unaided private educational institutions as "unfortunate''. Responding to questions, Congress spokesperson Anand Sharma said Parliament could not be gagged and as elected representatives of the people, members take up for discussions concerns of society. He said the Government had made it clear in Parliament that it would examine the Supreme Court's order of August 12 and also possible measure which might be required as demanded by all sections. The Communist Party of India said in a parliamentary democracy, legislature, judiciary and executive had to work within parameters prescribed for each. Party national secretary D. Raja said: "After all, judiciary is expected to interpret and uphold law and law is made by Parliament, which is the forum that reflects the will of the people. It is not fair for judiciary to dictate policy.'' Special Correspondent reports from KOCHI: The former Judge of Supreme Court, V.R. Krishna Iyer, in a statement, writes: "I hold the Supreme Court, in its holistic dimension, in high esteem. Its great virtue is patient hearing, never furious outburst. Its wisdom is profound and never provoked by the executive or the legislature. After all, if the court goes wrong, it has the power to set itself right. Likewise, if the executive and the legislature go beyond their power or commit egregious error, the last word still belongs to the Supreme Court. Infallibility, however, is papal folly and authoritarian intoxication. Our great judges are free from `never-error syndrome'."
