Well balanced

The editorial, `Maintaining the balance' (Aug. 26) is well balanced. As far as possible, the Government should not dictate to unaided professional institutions regarding the quota. Of course, legislation can ensure monitoring of admissions and the merits of those selected. Anything else will create unnecessary problems.

Your have correctly outlined the roles of the legislature and the judiciary. That the elected representatives of the people have the right to make laws is beyond doubt. But interpretation of the laws is in the domain of the judiciary.

Your suggestion that the Central and State Governments persuade the private colleges to commit some seats to specific economically weaker categories with the assurance of concessions is well meant. Such a course will be more useful than the intended legislation on the subject.

The editorial has brought out all aspects of the issue. It is a time-tested practice in democratic countries to "overturn" a court's decision on the constitutionality of a measure by passing a law. In 1969 Indira Gandhi had resorted to this method in nationalising 14 banks.
