Pune firm sues BWSSB over contract

Sewer work taken up under National River Commission Funding plan

BANGALORE: A Division Bench comprising Justice S.R. Nayak and Justice V. Jagannathan allowed two writ appeals by the Srimuli Builders, Pune, relating to the contract for replacement of existing trunk sewers and laying of new sewers under the National River Commission Plan Funding in Koramangala and Challaghatta Valleys taken up by the Bangalore Water Supply and Sewerage Board (BWSSB).

Hindrance to work

The appellant said though they had bagged the contract, they could not complete work on time as they faced problems from the traffic police, Bangalore Mahanagara Palike, Bangalore Development Authority and others.

Petition dismissed

On January 27, BWSSB terminated the contract and a single judge had on April 15 dismissed a petition by the company.

The Bench, which allowed the appeals, observed that the decision making process stood vitiated.

It said the BWSSB decision to terminate the contract could not be sustained in law.
