High Court directive on custodial death

NEW DELHI: The Delhi High Court has directed the Delhi Government to pay a compensation of Rs.3lakhs to a widow from Haryana whose husband had died in Delhi Police custody at the Alipur police station in Delhi in August 1999.

Rejecting a contention by counsel for the city Government that the woman's petition was time-barred and that she could not seek a compensation through a writ petition, Justice R.S. Sodhi said that the compensation ordered by the Court was without any prejudice to the petitioner's right to seek damages against the State.

On the objections raised the city Government's counsel, Mr. Justice Sodhi observed: "It does not behove the State to take a plea of limitations in a case of custodial death.''

Compensation

Mr. Justice Sodhi said that the Government could recover the compensation amount from the accused policemen.

The widow, Sunita, had demanded a compensation of Rs. 9 lakhs.

Bus stop

The Alipur police had picked up the victim, Mohinder Kumar, from a bus stop in connection with an alleged crime on August 15, 1999.
