Supreme Court to hear tribal land case on November 25

NEW DELHI: The Supreme Court will hear on November 25 an appeal against a 2000 Kerala High Court order striking down the constitutional validity of an enactment by the State Legislature watering down the rights of tribals to their alienated lands.

The hearing was fixed by a Bench comprising Justice G.P. Mathur and Justice P.K. Balasubramanyan after P. Nalla Thampy Thera, on whose petition the impugned order was passed, sought an early hearing of the appeal by the State Government which was pending before the apex court for the past four years.

The impugned legislation was enacted by the Government in 1999 allegedly to nullify a 1993 High Court direction to restore lands to tribals as per the Kerala Schedule Tribes Restriction on Transfer and Restoration of Alienated Lands Act, 1975.

After the High Court struck down the validity of the anti-tribal legislation on August 24, 2000, the Government had filed an appeal before the apex court. — UNI
