The Supreme Court's decision to examine the alleged mala fide action of Buta Singh in recommending the dissolution of the Bihar Assembly is welcome. On earlier occasions too the Court has observed that a Governor cannot, in the exercise of his or her discretion, do anything that runs contrary to the Constitution. We have any number of instances when Governors have acted in an unconstitutional manner. Not all of them have been held accountable. The immunity enjoyed by Governors from court proceedings under Article 361 should therefore be removed.
