NEW DELHI: The Centre on Thursday requested the Delhi High Court to quash the appointment of Lt Col (Rtd) A R N Setalwad as Medical Council of India (MCI) Secretary terming the same as illegal for want of approval from the Appointments Committee of the Cabinet (ACC). In an affidavit filed in response to a PIL challenging Setalwad's appointment and seeking a CBI probe against him, Centre said as per the Government of India orders, the approval of ACC was a pre-requisite for making appointments to the post in the pay scale of Rs 18,400-22,400, which was also the pay scale of MCI Secretary. Additional Solicitor General (ASG) P P Malhotra pointed out that no vigilance clearance was obtained in this case. ``Due to the fact that allegation against Respondent No.3 (Setalwad) of embezzlement of Rs 8 crore from Bhavnagar Medical College, Gujarat and vigilance inquiry which is said to be pending, the appointment of Respondent No.3 is illegal and void,'' the affidavit said. The Centre alleged that Setalwad was passing on files to former MCI president Dr Ketan Desai who was removed from the post in pursuance of orders passed by the Delhi High Court. PTI
