Court turns down plea of Deendar activist

BANGALORE: The Karnataka High Court on Thursday rejected a petition by an activist of Deendar Anjuman seeking quashing of proceedings against him.

In his petition, Sheikh Ameer Ali of Nalgonda, Andhra Pradesh, said he was an activist of Deendar Anjuman which was founded in 1924.

`False cases'

He said the organisation had branches in Bangalore, Mysore, Gulbarga, Tumkur, Hubli, Dharwad, Chickaballapur and Ganeshgudi.

He said the J.J. Nagar police in Bangalore had implicated him in a case and accused him of supplying explosives to some persons.

He said false cases were foisted against him under Section 124 (A), 153 (A), 259, 436, 427 read with Section 120 (B) of the Indian Penal Code and Sections 5,3,4 and 9 (B) of the Explosives Substances Act.

Conspiracy

He said the J.J. Nagar police had in 2001 charged him along with 28 others with entering into a conspiracy by selling gelatine sticks to two accused who had carried out bomb blasts in churches in Bangalore, Hubli, Wadi, Gulbarga.

He said he had already been tried by a Hyderabad court for similar offences and the J.J. Nagar police had used the same sections and Acts as had been done by the Hyderabad police for implicating him in a case in Bangalore. He said he could not be tried for the same offence twice and that he was entitled to be discharged.

He urged the court to quash all further proceedings against him and also call for records.

Justice Mohan Shantanagouder dismissed his petition and said he could be tried in Karnataka as both the cases were different.

He also refused the petitioner's request to grant time to file a special leave petition in the Supreme Court, saying that there was prima facie a case against him.
