NEW DELHI: The Supreme Court on Friday permitted over 1,000 self- financing engineering colleges in 22 States to fill nearly one lakh vacant seats for 2005-2006 on the basis of higher secondary examination marks. A Bench comprising Justice Y.K. Sabharwal and Justice C.K. Thakker passed the order on an application filed by T.D. Naidu, president of the All India Medical and Engineering Colleges Association. Appearing for the petitioner, Senior counsel for the petitioner Mukul Rohatgi said over one lakh seats remained vacant after counselling. If permission was not granted to fill the seats on the basis of higher secondary examination marks, all the seats would go waste, he said. Senior counsel. K. Ramamurthy appearing for Tamil Nadu urged the court that higher standards fixed by the State should be adhered to while granting admissions. The order said that it appeared that in the engineering colleges, members of petitioner associations in 22 States, a large number of seats in the government and management quota were unfilled even after admitting those who were on the list prepared on the basis of the qualifying common entrance examination conducted either by the State or by the consortium of colleges. Considering the difficulties expressed by the petitioner, The Bench said that it would be open to the respective States to send a list of candidates from among the CET conducted by it or by the consortium to the colleges concerned within a week. In case such a list was received, the colleges could give admission to those candidates.
