KOCHI: The Ernakulam Chief Judicial Magistrate V.T. Raghunath will visit the Pious X Convent Hostel in Kottayam on September 30 to see the scene of occurrence for appreciating the evidence given in the case relating to the death of Sister Abhaya. The Magistrate would visit and carry out inspection at the Convent between 11.30 a.m. and 12 noon in the presence of the counsel for Abhaya's father and the CBI. The Magistrate is conducting the inspection as per Section 310 of the Criminal Procedure Code. As per the Section, any judge or magistrate might, at any stage of inquiry or trial or other proceedings after due notice to the parties, visit and inspect any place in which an offence is alleged to have been committed or any place, which, in his opinion, was necessary to view for the purpose of properly appreciating the evidence given at an inquiry or trial. The body of Abhaya, a 21-year-old inmate of the Pious X convent Hostel in Kottayam, was found in March 1992 in a well on the Convent premises. The CBI, which took over the investigation, had concluded in November 1996 that the death was a homicide but the case remained "untraced." The Ernakulam Chief Judicial Magistrate did not accept the final report of the CBI and had directed the CBI to conduct a fresh investigation. The Magistrate on Monday gave the notice of his inspection when the case came up before him.
