AHMEDABAD: The Gujarat Government has moved an application before the Central Administrative Tribunal (CAT) for removing Chief Minister Narendra Modi's name from the list of respondents in the petition filed by Additional Director-General of Police (ADGP) R.B. Shreekumar. The Government pleader said the Chief Minister was not involved in "denial'' of promotion to Mr. Shreekumar, as alleged by the petitioner. Mr. Modi had not seen Mr. Shreekumar's file and had "no opportunity'' to consider granting or denying of promotion to him, he said. The Pleader said an attempt was made to defame Mr. Modi by unnecessarily dragging his name in the list of six respondents. Mr. Shreekumar's lawyer, Anand Yagnik, said the Chief Minister, along with the Chief Secretary, Additional Chief Secretary (Home) and the Director General of Police were the "necessary parties'' in taking such important decisions such as promotions to senior police officers and that without any of them, "effective adjudication'' would be impossible. Any decision, either to grant or deny promotion, would become effective only after it was considered by the "appointing authority,'' which in this case was the Chief Minister who holds the Home portfolio. He described as a "blatant lie'' the Government claim that Mr. Modi had no opportunity to consider Mr. Shreekumar's promotion. The Government also moved another application for "correcting the jurisdiction'' of Mr. Shreekumar's case.
