Case against DMK chief posted to October 31

Defence counsel seeks more time

CHENNAI: The XVIII Metropolitan Magistrate, Saidapet, on Tuesday posted to October 31 a case against former Chief Minister M. Karunanidhi for allegedly hurting feelings of Hindus in an article written by him.

S. Selvam, Editor, Murasoli, which carried the article, has also been cited as accused.

The charge sheet was filed in the XVII Metropolitan Magistrate court for an offence under Section 295-A (deliberate and malicious acts intended to outrage the religious feelings of any class by insulting its religion or religious beliefs) of the Indian Penal Code.

Taking the charge sheet on file, the court had issued summons for the appearance of the accused.

When the case came up in the court of XVIII Metropolitan Magistrate K. Gayathri, who is holding additional charge of the XVII Metropolitan Magistrate's court, the accused were not present. A petition under Section 317 of the Cr.P.C., seeking to dispense with the presence of the accused, was filed. It was allowed.

Defence counsel sought more time to submit arguments on the petition under Section 205 of the Cr.P.C. seeking to dispense with the presence of the accused.

Prosecutor Jayaratnakumar said the accused should come to the court for the first appearance.
