Kattapanchayats: 21 cases filed

Compliance report filed in High Court

CHENNAI: A total of 21 criminal cases were registered in Tamil Nadu between July and September 2005 against persons perpetrating the practice of kattapanchayats in the State, the Madras High Court has been informed.

In a compliance report filed before a Division Bench comprising the Acting Chief Justice N. Dhinakar and Justice F.M. Ibrahim Kalifulla, the Chief Secretary, N. Narayanan, said that while 13 cases were under investigation, two were closed as `mistake of fact.' Five cases are pending in trial courts whereas a kattapanchayatdar was found guilty and awarded punishment in one case.

The quarterly report was filed following a July 5 order of the First Bench directing the Government to ask all its authorities to take stern action, in accordance with law, to put down "unlawful hooligan activities that have mushroomed in Tamil Nadu." The Bench had also asked the Government to institute criminal prosecution against those involved in kattapanchayat and to take disciplinary action against officials colluding with such kattapanchayatdars.

The order was passed on a public interest litigation petition by advocate K. Gopal, against the Chennai city police's failure to register his complaint against the kattapanchayatdars of the Nalla Thanneer Odai Kuppam Meenava Grama Sabha, who excommunicated five families of fishermen after they refused to part with the tsunami relief materials offered to them by service agencies. He also wanted the refund of Rs. 40,000 collected from him towards fine.

Referring to the case, the Chennai City Commissioner of Police submitted that cases were registered against 19 kattapanchayatdars of Nalla Thanneer Odai Kuppam and that they were arrested and remanded to judicial custody as per the court directive. The fine amount of Rs. 40,000 collected from Mr. Gopal's family too was refunded on September 25, he said.

The matter was then adjourned to January 5 for filing of further compliance reports.
